“淑女屋”被告商标侵权商标保护再引关注

“淑女屋”——这个来自深圳的知名品牌，因为公主般的服装风格而赢得了年轻女孩的喜爱。近日，湖北的一位却把“淑女屋”告上了法庭。说，此“淑女屋”侵犯了他的“淑女屋”。

昨天早上，这场知识产权官司在杭州市中级人民法院开庭审理。同时成为被告的，还有“淑女屋”在杭州的销售商——杭州利星名品百货广场公司(下简称利星百货)。

要求赔偿183万元

原告方介绍，他是注册商标“淑女屋”的商标权人。该商标由陈先生于2007年7月注册，去年5月份转让给了他。此“淑女屋”核定为鞋、婴儿全套衣及运动鞋类使用。

而近期，原告在杭州、武汉等城市均发现了被告一——深圳市淑女屋时装股份有限公司(下简称深圳淑女屋公司)在其专卖店、相关卖场等营业场所大量销售标注“淑女屋”商标的鞋类产品，他对这些行为都进行了公证证据保全。表示，被告未经许可生产和销售带有“淑女屋”商标的鞋类商品，已经侵犯了他的商标专用权。

为此，的要求是，被告停止侵权，除在杭州、深圳等地媒体上发表道歉声明外，还要赔偿经济损失180万元和合理调查费用3万元，共计183万元。

被告称原告是恶意抢注

在深圳淑女屋公司看来，原告的注册商标“淑女屋”是恶意抢注并恶意转让获得，目的就是将注册商标作为索赔工具使用。

被告一表示，他们公司经过近20年的发展，“淑女屋”服装已在全国名气不小，全国有超过600家的销售终端，更是在广东省取得过不少荣誉。而原告在去年5月从注册人陈先生那受让取得“淑女屋”商标后，未进行过任何生产或销售“淑女屋”商标的鞋、婴儿全套衣、运动鞋等商品。相反，在去年6月份，原告甚至提出过要把他手上的“淑女屋”商标转让给深圳淑女屋公司，要价高昂遭到了拒绝。

“我们的‘淑女屋’商标由图形和经过加工的美术字组成，而原告的‘淑女屋’仅为普通的汉字，两者具有显著区别。”被告一的代理人认为，原告才是“搭便车”、“傍品牌”，恶意抢注、受让牟利。

利星百货作了简单的答辩，他们表示没有侵犯原告的商标专用权。“淑女屋”在利星百货设立专柜，提供过“淑女屋”商标注册证，并不得有侵犯他人知识产权的不法行为。

孰是孰非，需要等法院进一步审理作出的判决。

名企遭遇傍品牌已不算新鲜了，甚至出现了不少专门做商标注册转让的公司，专门瞄准知名品牌的漏洞进行抢注和转让。这些商标，购买者还不少，以中小企业为主，这些企业没有品牌或品牌出不了名，希望借品牌的光。他们往往不懂得也没有精力去研究商标注册，愿意花钱买一个现成的。针对中小企业的需求，也就诞生了这样的行业，专门研究、设计和转让与知名品牌类似的商标，被社会称为“商标注册流氓”。
